ACS held jointly liable in Spanish state-road maintenance cartel

Summary

Spain's CNMC found a very serious cartel that manipulated State Road Network maintenance tenders through coordinated bids, agreed discount thresholds and cover offers. The conduct operated from February 2014 through December 2018 and affected 71 of 101 Ministry tenders, representing more than EUR 530 million in awarded contracts. CNMC expressly held ACS, Actividades de Construcción y Servicios, S.A. jointly liable with API Movilidad, S.A. The authority imposed total cartel fines of EUR 61.28 million and referred the matter for determination of public-contracting bans.
