Target Paid $2.8 Million After EEOC Found Hiring Assessments Discriminated by Race and Sex

In August 2015, Target Corporation agreed to pay $2.8 million to resolve an Equal Employment Opportunity Commission discrimination finding concerning pre-hire employment assessments. The EEOC found reasonable cause to believe that three assessments formerly used by Target disproportionately screened out applicants for professional positions based on race and sex and were not sufficiently job-related and consistent with business necessity. The EEOC also found that another assessment constituted a prohibited pre-employment medical examination under the Americans with Disabilities Act. Thousands of applicants were affected. Target discontinued the challenged tests and agreed to monitoring, recordkeeping, validation and training measures.
