BNP Paribas Bank Polska S.A. Rotten Score Breakdown

In September 2020 the President of UOKiK found prohibited clauses in BNP Paribas Bank Polska mortgage-contract annexes concerning how foreign-exchange rates were determined for euro- and Swiss-franc-linked loans. UOKiK said the clauses gave the bank subjective discretion over exchange-rate spreads and prevented borrowers from independently verifying whether instalments were being calculated fairly. The authority imposed a PLN 26,625,686 fine and ordered the clauses discontinued. The decision was appealed and final judicial closure was not established in this review, so the record is marked unresolved.
