ČEZ, a.s. Rotten Score Breakdown

The Czech competition authority found that ČEZ used prohibited contractual provisions restricting trading partners' freedom to resell exported electricity back into the Czech Republic. The authority concluded that the arrangements could hinder development of competition in the electricity sector and noted that ČEZ held a dominant market position. A CZK 7.5 million fine was imposed and performance of the prohibited agreements was banned. The Regional Court in Brno later rejected ČEZ's challenge in full, confirming the competition authority's decision.
