EDP - Energias de Portugal, S.A.

The Portuguese Competition Authority found that EDP - Energias de Portugal, S.A. and companies in the Sonae group entered into an anti-competitive non-compete agreement in connection with the 2012 "Plano EDP Continente" commercial partnership. The agreement restricted Sonae from entering the electricity-supply market in mainland Portugal for two years. The AdC fined EDP itself EUR 2.9 million, alongside additional fines on EDP Comercial and Sonae companies. Courts subsequently upheld the infringement and found it intentional. In July 2026 the Lisbon Court of Appeal upheld the AdC's appeal on limitation issues and ruled that the proceedings were not time-barred, so the case is conservatively marked unresolved while the litigation continues.
