Hitachi, Ltd.

The SEC charged Hitachi, Ltd. with FCPA books-and-records and internal-control violations arising from improper payments connected with two South African power-plant contracts. The SEC alleged that Hitachi knew a local partner was a funding vehicle for the ruling African National Congress, paid approximately $5 million in dividends and $1 million in success fees, and inaccurately recorded payments. Hitachi agreed on September 28, 2015 to pay $19 million without admitting or denying the allegations; the settlement was subject to court approval.
