Jazz Pharmaceuticals plc

Jazz Pharmaceuticals plc and related entities agreed to pay USD 57 million in April 2019 to resolve U.S. government civil allegations that Jazz used purportedly independent charitable foundations as conduits to pay Medicare patients' copays for Jazz drugs Xyrem and Prialt, thereby inducing purchases reimbursed by Medicare. The government alleged that Jazz was the sole donor to a narcolepsy fund that almost exclusively assisted Xyrem patients and that Jazz changed its free-drug programme so Medicare patients were instead referred to the foundation. The covered conduct ran from January 2011 through May 2014. The settlement resolved civil False Claims Act and related claims without a criminal admission.
