The Czech Office for the Protection of Competition found that the former ČESKÝ TELECOM, now O2 Czech Republic, abused its dominant position through pricing plans for households and small businesses that bundled call credits or free minutes into fixed monthly charges. The authority said the tying hindered development of alternative operators and restricted consumers' ability to obtain competing services. A CZK 205 million fine was imposed, paid, and upheld in full by the Regional Court in Brno in September 2006. The Czech competition authority found that the former ČESKÝ TELECOM, now O2 Czech Republic, abused its dominant position in 2001 and 2002 through contracts with nearly 3,000 business customers. Customers committed to minimum monthly call volumes, could not terminate agreements early and were restricted from using voice services from competing providers. The authority characterised the arrangements as barriers to competition and prohibited loyalty rebates. After multiple rounds of judicial review, a CZK 91,909,700 fine was confirmed by the Regional Court in Brno in October 2014. The Czech competition authority found that O2 Czech Republic and four other IT companies coordinated conduct and exchanged information in connection with the City of Přerov public contract for data and information transmission. The participants divided contract performance and structured bids so that the agreed consortium offer would win; a cover bid was also submitted. O2 participated in contacts concerning the project from at least August 2012. In a settlement procedure the companies admitted the anticompetitive conduct, waived appeals and received reduced fines. O2's fine was CZK 38.284 million; the decision became legally effective on 4 March 2020.
