PKN ORLEN S.A. Rotten Score Breakdown

Poland's competition authority found that PKN ORLEN and a fuel station in Krasnystaw entered into an anti-competitive agreement containing a clause allowing the network organiser to fix fuel selling prices at the station. UOKiK stated that agreements whose object or effect is to restrict competition, including price fixing, are prohibited regardless of whether the agreed objective was ultimately implemented. In August 2010 the authority imposed a PLN 52,736,994.19 fine on PKN ORLEN. The decision was appealable; because final appeal closure was not established in this review, this record is marked unresolved.
