Spain's competition authority found that Telefónica abused its dominant position in fixed telecommunications by giving its own Telefónica Data subsidiary an advance advantage in access to the local loop, an essential input needed by rival providers to offer ADSL internet services. The authority also found abusive contractual wording that could lead customers to believe Telefónica Data enjoyed competitive advantages from belonging to the Telefónica group. Spain's CNMC fined Telefónica EUR 5 million in July 2023 for again breaching commitments accepted when it acquired DTS in 2015. CNMC found that the terms of Telefónica's agreement with DAZN concerning exclusive Formula 1 broadcasting rights violated the merger remedies, including by excluding Formula 1 content from Telefónica's 2021 wholesale channel offer and creating de facto exclusivity.
