In January 2025, American Express Company agreed to pay a $108.7 million civil penalty to resolve U.S. Department of Justice allegations involving deceptive sales practices and false account information. DOJ alleged that American Express deceptively marketed credit-card and wire-transfer products to small-business customers and entered false or “dummy” Employer Identification Numbers into credit-card accounts. The government said the practices violated the Financial Institutions Reform, Recovery and Enforcement Act. In May 2022, the U.S. Department of Justice reached a settlement with American Express Company over job advertisements that unlawfully restricted positions based on citizenship status. The Justice Department's Immigrant and Employee Rights Section said American Express was among employers that posted discriminatory advertisements on college recruiting platforms. The settlement required American Express to pay a $29,008 civil penalty, train recruiting personnel on the Immigration and Nationality Act's anti-discrimination requirements and change recruiting practices.
