Telenor ASA

The Norwegian Competition Authority found that Telenor abused its dominant position by changing the pricing structure in its network-access agreement with Network Norway in a way that hindered development of a third mobile network in Norway. The conduct ran from August 2010 to June 2014. A NOK 788 million fine was upheld by the Competition Appeals Tribunal and Gulating Court of Appeal; in November 2021 the Supreme Court Appeals Selection Committee declined further review, making the judgment final. The EFTA Surveillance Authority concluded that Telenor abused its dominant position through a margin-squeeze pricing strategy in residential mobile broadband. ESA found that from 2008 through 2012 Telenor's wholesale access prices could exceed its own retail prices, making it impossible for dependent rivals to compete viably without losses. ESA imposed a EUR 111.951 million fine in 2020. The EFTA Court dismissed Telenor's annulment action in May 2022 and upheld the decision and fine.
