Vivacom Bulgaria EAD

In May 2015 Bulgaria's Commission for Protection of Competition imposed a BGN 3.75 million fine on Bulgarian Telecommunications Company, operating under the Vivacom brand, after a repeat investigation of a complaint by Eastern Telecommunications Company. The case concerned Vivacom's unilateral termination of an interconnection agreement and the competition authority found unfair conduct affecting a rival operator. Bulgaria's Supreme Administrative Court upheld a lower-court judgment rejecting Vivacom Bulgaria's challenge to a Consumer Protection Commission order prohibiting a misleading unfair commercial practice concerning the conditions for using EON TV Mobile. The courts found that Vivacom omitted material information about which devices were compatible with the service, information capable of affecting a consumer's decision to enter into the agreement. The underlying consumer complaint was filed on 15 November 2022, the prohibition order was issued on 12 July 2023, and the Supreme Administrative Court judgment in administrative case 1130/2025 was final.
