The European Commission found Deutsche Telekom liable with its subsidiary Slovak Telekom for abuse of a dominant position in the Slovak broadband market. The conduct involved restrictions on access to the local loop and a margin squeeze that hindered competing broadband providers. Deutsche Telekom was also subjected to a separate fine reflecting repeated infringement. On appeal, the EU General Court upheld the core infringement but reduced the amounts. In May 2003, the European Commission found that Deutsche Telekom AG had abused its dominant position by charging unfair prices for access to its local fixed telecommunications network. The Commission found that Deutsche Telekom charged competitors wholesale access fees that created a margin squeeze relative to retail prices, significantly impeding competition and market entry in Germany. The infringement began in 1998. The Commission ordered Deutsche Telekom to end the conduct and imposed a €12.6 million fine.
